Pursuant to Clause 6, Article 3 of Decree 96/2016/ND-CP, trading in vehicle signaling equipment is given priority as a business line with conditions on security, order and scope of management. Accordingly, trading in vehicle signaling equipment has priority rights, including: Manufacturing, assembling, importing, exporting, buying and selling flags, lights, and sirens to signal priority for motor vehicles.

Conditions for trading priority vehicle signaling equipment

Based on Article 7, Article 25 and Article 31 of Decree 96/2016/ND-CP, conditions for trading in priority vehicle signaling devices must meet security and order conditions applicable to conditional business lines. Specifically:

1. Registered, licensed or established in accordance with Vietnamese law.

2. The person responsible for security and order of the business establishment must not fall into one of the following cases:

For Vietnamese people:

  • Have been criminally prosecuted and Vietnamese or foreign prosecution agencies are investigating, prosecuting, and adjudicating.
  • Have a criminal record for crimes of infringing on national security or other crimes due to intentional errors and have been sentenced to over 3 years in prison or more and have not had your criminal record erased; are in the period of temporary suspension of serving a prison sentence; are serving a non-custodial reform sentence; are under house arrest, banned from residence, banned from holding positions, banned from doing business in investment and business lines subject to security and order conditions according to the Court’s decision.
  • Being subjected to educational measures in communes, wards, and towns; there is a decision to apply administrative measures while waiting for the implementation of the decision; are addicted to drugs; being temporarily suspended or temporarily suspended from complying with the decision to send to a compulsory education facility or to a compulsory drug treatment facility; administrative measures have been applied but the time limit has not been sufficient to be considered as not yet subject to administrative measures.

For Vietnamese residing abroad holding foreign passports and foreigners: Not yet granted a residence permit by a competent Vietnamese agency.

3. Regularly and continuously maintain the conditions of security and order specified in this Decree throughout the course of business operations.

4. Do not use business establishments to carry out activities contrary to the provisions of law that affect the security, order, morality, customs and traditions of the nation.

5. Implement quarterly or irregular reporting on the security and order situation according to the guidance of the Ministry of Public Security.

6. Comply with inspection, examination and handling of violations by the Police and competent state management agencies.

7. Only employ employees working in business establishments who are 18 years of age or older; have full capacity for civil acts; Not addicted to drugs or currently under investigation, prosecution or trial; are in the period of temporary suspension of serving a prison sentence; people who are on conditional release from prison; people who are serving non-custodial reform sentences.

8. Do not import or produce equipment that exceeds the sound and light standards for horn and light equipment specified in Decree No. 109/2009/ND-CP.

9. Selling the correct quantity and type of vehicle signaling equipment with priority rights stated in the license of the competent authority according to regulations.

Documents must be submitted when registering to trade in priority vehicle signaling equipment

Pursuant to Article 14 of Decree 96/2016/ND-CP (amended by Clause 2, Article 1 of Decree 56/2023/ND-CP), Article 21 to Article 25 of Decree 01/2021/ND-CP, the composition Documents required when registering to trade in priority vehicle signaling equipment include:

  • Document requesting the issuance of Certificate of satisfaction of security and order conditions (Form No. 03 in Appendix issued with Decree 56/2023/ND-CP).
  • Valid copy of one of the documents on business establishment such as: Business registration certificate; Business registration certificate; Investment registration certificate; Certificate of operation registration of branches and units under the enterprise; Business household registration certificate.
  • Authorization document for the person to submit the application and receive the results if not the legal representative of the enterprise or business household.
  • The warehouse rental contract ensures safety conditions for fire prevention and fighting in case the enterprise or business household does not have a warehouse to store raw materials or products.
  • Background statement (Form No. 02 in the Appendix issued with Decree 56/2023/ND-CP) or Personnel declaration (Form No. 02b in the Appendix issued with Decree 96/2016/ND-CP).

Procedures for establishing a company selling priority vehicle signaling equipment

Steps to establish a company selling priority vehicle signaling equipment, according to the provisions of Article 23 of Decree 96/2016/ND-CP (supplemented by Point c, Clause 4, Article 1 of Decree 56/2023/ND-CP), Article 26 of the Law on Enterprise and Article 32 of Decree 01/2021/ND-CP, including:

Step 4: Within 03 working days from the date of receipt of the application:

  • The business registration agency is responsible for reviewing the validity of business registration documents and granting business registration;
  • In case the dossier is not valid, the Business Registration Authority must notify in writing the content that needs to be amended or supplemented to the business founder;
  • In case of refusal to register a business, it must be notified in writing to the business founder and clearly state the reason.
