Conditions for security service business

Pursuant to Article 7 of Decree 96/2016/ND-CP, conditions for security service business shall include security and order conditions applicable to all industries and professions and specific conditions for security service business, according to Article 11 of this Decree. Specifically:

1. Registered, licensed or established in accordance with Vietnamese law.

2. The person responsible for security and order of the business establishment must not fall into one of the following cases:

For Vietnamese people:

  • Has been criminally prosecuted;
  • Have a criminal record of serious crimes according to the provisions of this Decree;
  • Being subject to administrative or educational sanctions at the commune.

For Vietnamese residing abroad holding foreign passports and foreigners:

  • Have not been granted a residence permit by a competent Vietnamese agency.

3. Satisfactory conditions for fire prevention and fighting safety according to the provisions of the Law on Fire Prevention and Fighting.

4. Being a business.

The person responsible for the security and order of the security service business must have a college diploma or higher and is not the person responsible for the security and order of the business establishment security services that in the preceding 24 months have had their Certificate of satisfaction of security and order conditions revoked indefinitely.

6. In case a Vietnamese security service business is a joint venture with a foreign business establishment:

7. Joint ventures are only allowed in cases where investment in machinery and technical equipment for security work is required and can only be carried out in the form of foreign business establishments contributing capital to purchase machinery and technical equipment for security work.

In case a foreign business establishment invests and contributes capital to a Vietnamese security service business establishment:

  • Be an enterprise that has been operating a security service business continuously for at least 5 years;
  • The representative of the capital contribution of a foreign business establishment is a person who has not been handled by the legal authority of the foreign country where they do business for violations related to security service business activities from warning or higher;
  • The capital contribution of foreign business establishments can only be used to purchase machinery and technical equipment for security work. The investment capital of the foreign business establishment is at least one million US dollars.

Responsibilities of security service businesses

General responsibility

Pursuant to Article 25 of Decree 96/2016/ND-CP, the general responsibilities of security service establishments are:

  1. The person responsible for security and order of the business establishment must be responsible for ensuring security and order conditions; Fully implement the regulations on security and order in this Decree and other relevant laws.
  2. There must be a written notice accompanied by a copy of the Certificate of satisfaction of security and order conditions sent to the Police of the commune, ward or town where the business operates.
  3. Regularly and continuously maintain the conditions of security and order specified in this Decree throughout the course of business operations.
  4. Do not use business establishments to carry out activities contrary to the provisions of law that affect the security, order, morality, customs and traditions of the nation.
  5. Detect and promptly notify the Police about suspicious signs or incidents related to security and order at business establishments.
  6. In case the Certificate of satisfaction of security and order conditions is lost, a written notification must be sent to the competent police agency.
  7. Implement quarterly or irregular reporting on the security and order situation according to the guidance of the Ministry of Public Security.
  8. Comply with inspection, examination and handling of violations by the Police and competent state management agencies.
  9. Only employ employees working in business establishments who are 18 years of age or older; have full capacity for civil acts; Not addicted to drugs or during investigation.
  10. Business establishments are responsible for providing the competent Police agency with the following documents:
  • List of people working in the business;
  • Resume and personnel declaration of the person responsible for security and order of the business establishment, except for the person named in the Certificate of satisfaction of security and order conditions;
  • Documents proving that the business establishment meets all conditions for each type of industry and profession specified in Articles 8, 11 and 12 of this Decree;
  • Statistics of vehicles serving security work (if any);
  • Business area diagram for explosive materials businesses; trading in support tools; paintball gun business; casino business; trading in electronic games with prizes for foreigners; accommodation service business; karaoke and discotheque service business; massage service business; pawnshop service business.
  1. Have a written request to the competent Police agency to re-issue or replace the Certificate of satisfaction of security and order conditions in case of need to re-issue or re-issue.
  2. Organize training on ensuring security and order for security guards and other relevant employees in business establishments according to instructions from competent police agencies.
  3. If a business establishment temporarily ceases operations, before the date of temporary suspension, there must be a written notification to the competent police agency and the police of the commune, ward or town where the establishment operates its business, which clearly states the reason and duration of the temporary suspension.
  4. For establishments trading in weapons and explosives: when ceasing business operations, a full inventory of the remaining goods (if any) must be made and a written notification must be sent to the police or other agencies. Military authorities from the provincial level or higher where the business operates to handle according to the provisions of the law.
  5. Prepare business management books suitable for each type of industry and profession according to the uniform form of the Ministry of Public Security.
  6. Pay the appraisal fee to issue the Certificate of eligibility for security and order, and the testing fee to issue the Security Professional Certificate according to the provisions of the law.

Private responsibility

Pursuant to Article 32 of Decree 96/2016/ND-CP (amended and supplemented in 2023), the specific responsibilities of security service establishments are:

  1. Selecting and employing security service staff who meet the standards of this Decree requires.
  2. Only use security service staff who have been trained and issued a Security Professional Certificate.
  3. Have a labor contract with security service staff according to the provisions of the law.
  4. Only carry out training of security service staff after the competent Police agency has written approval for the content of the curriculum and training program for security service staff.
  5. Issue signs and uniforms (with logos attached to shirts registered with the competent police agency) to security guards under management.
  6. Sign an economic contract to provide security services before implementing security work.
  7. Do not perform security services for objects, targets or activities contrary to the provisions of the law.
  8. Within 05 days from the date of deployment of the protection target, a written notice must be sent with a valid copy of the Certificate of eligibility for security and order and related documents to the Police of the commune, ward or town where the protection target is deployed.
  9. For foreign-invested business establishments, within 20 days from the date of commencement of business operations, they must provide the competent police agency with a list of machinery and technical equipment serving security work.
