Is reporting the status of foreign labor use mandatory?

Pursuant to Clause 1, Article 6 of Decree 152/2020/ND-CP stipulating that foreign employers must report on the employment situation and do so before July 5 and January 5 of the following year.

In addition, according to the provisions of Point a, Clause 1, Article 32 of Decree 12/2022/ND-CP, fines range from 1,000,000 VND to 3,000,000 VND when not reporting the situation of using foreign workers.

Where to submit a report on the use of foreign workers?

Submit a report on the use of foreign workers to one of the following agencies:

  • In case the enterprise is subject to the issuance of work permits at the Ministry of Labor – Invalids and Social Affairs: The employer submits a report to the Ministry, and at the same time sends a report to the Department of Labor – Invalids and Social Affairs of the province or city where the foreign employee works.
  • In the remaining case: The employee submits a report to the Department of Labor, War Invalids and Social Affairs of the province or city where the foreign worker works.
