Conditions for obtaining a transport business license

To be eligible to apply for a transport license, individuals or transport business organizations need to meet the conditions specified in Decree 158/2024/ND-CP and related legal documents.

For passenger car transport

According to the provisions of Article 13 of Decree 158/2024/ND-CP on conditions for passenger transport by car as follows:

Regarding general requirements:

  • Cars must be legally owned or used by the passenger transport business unit, through a rental contract or business cooperation with an organization or individual. If the vehicle is owned by a cooperative member, a service contract is required that stipulates the cooperative’s management rights and responsibilities.
  • The vehicle must be installed with a trip monitoring device and a device to record the driver’s image as prescribed in Article 35 of the Law on Road Traffic Order and Safety.

Regarding shelf life:

  • Transporting passengers on fixed routes: Vehicles with a capacity of 8 seats or more, with a service life of not more than 15 years for routes over 300 km long and not more than 20 years for routes under 300km.
  • Bus: The vehicle has a capacity of 8 seats or more and has a service life of no more than 20 years.
  • Taxi: Vehicles with a capacity of less than 8 seats and an expiry date of no more than 12 years. Do not use vehicles converted from vehicles with a capacity of more than 8 seats into taxis.
  • Transport under contract: Vehicles with a capacity of over 8 seats, with an expiration date of no more than 15 years for routes over 300km and no more than 20 years for routes under 300km.
  • Particularly for vehicles with less than 8 seats using electronic contracts, the term must not exceed 12 years.

For transporting goods by car

  • The car must be legally owned or used by the freight transport business unit through a vehicle rental contract or business cooperation with an organization or individual.
  • If the vehicle is owned by a cooperative member, a service contract is required that stipulates the cooperative’s management rights and responsibilities.

Regarding shelf life: Vehicles must meet the requirements on shelf life as prescribed in the Law on Road and the Law on Road Traffic Order and Safety.

For passenger transportation by motorized four-wheeled vehicles

According to the provisions of Article 15 of Decree 158/2024/ND-CP on conditions for passenger transportation by four-wheeled motor vehicles as follows:

About car ownership:

  • Four-wheeled motor vehicles must be legally owned or used by the transport business unit through a rental contract or business cooperation with an organization or individual.
  • If the vehicle is owned by a cooperative member, a service contract is required that stipulates the cooperative’s management rights and responsibilities.

Regarding shelf life: Four-wheeled motor vehicles used for passenger transport business must have a shelf life of no more than 20 years.

For transporting goods by four-wheeled motor vehicle

Application for a transport license

According to Article 20 of Decree 158/2024/ND-CP, the application file for a transport license includes:

  • Application for business license according to the form specified in Appendix I of Decree 158/2024/ND-CP.
  • Copies of diplomas and certificates of the person directly operating the transport operation.
  • Copy of the Establishment Decision and documents related to the tasks of the safety management department of the transport business unit.
  • Copy of Decision on assignment of tasks to transport operators.

Process for granting transport business licenses

The process of granting a transport license is specifically stipulated in Clause 1, Article 21 of Decree 158/2024/ND-CP as follows:

Step 1: Submit application:

  • The transportation business unit submits 01 set of application documents for a Business License to the Department of Transport where the unit has its headquarters or branch.
  • Applications can be submitted through one of the following forms: in person, online or postal service.

Step 2: Processing documents:

  • In case any amendments or supplements are needed, the business license-issuing agency will notify the transport business unit within 03 working days from the date of receipt of the dossier.
  • Notification can be made in person or in writing, via the online public service system.

Step 3: Appraisal and issuance of License:

  • After receiving all valid documents, the business licensing agency will conduct an appraisal and issue the license within 05 working days.
  • If a business license is not granted, the licensing agency will respond in writing or notify via the online public service system, along with the reason for not granting the license.
