Declaration of conformity is a mandatory activity.

If a product or good is managed by multiple different technical regulations, the organization or individual must register a declaration of conformity with each corresponding specialized agency. The conformity mark may only be used after the product or good has fully complied with all management measures specified in the respective technical regulations.

Before market circulation, organizations and individuals trading in animal feed and raw materials for aquafeed production in Vietnam must declare conformity for commercial animal feed and raw materials for aquafeed. However, business households (producing, trading, primary processing) are not required to declare conformity for commercial traditional feed and raw materials for aquafeed.

For traditional feed, complete mixed feed, concentrated feed for livestock, and raw materials for aquafeed, the declaring organization or individual may choose one of three methods:

  • The result of a self-assessment of conformity by the organization or individual.
  • The certification result from a certification body that is registered or recognized according to legal regulations.
  • The certification result from a certification body that is designated according to legal regulations.

For feed supplements, the declaring organization or individual must base the declaration on the certification result from a designated regulation conformity certification body.

Registration Procedure for Animal Feed Regulation Conformity Certification

Certification Registration Dossier

Pursuant to Clause 4, Article 1 of Circular 02/2017/TT-BKHCN (amended by Clause 4, Article 19 of Circular 06/2020/TT-BKHCN), the dossier for declaration of conformity is specified as follows:

The declaring organization or individual prepares and submits the dossier directly or by post to the specialized agency designated by the managing ministry or provincial/municipal People’s Committee.

  • Dossier based on self-assessment results (First-Party):

    • A Declaration of Conformity (using Form 2. CBHC/HQ in Appendix III of Circular 28/2012/TT-BKHCN).
    • A self-assessment report containing:
      • Name of organization/individual; address; phone, fax.
      • Name of product/good, manufacturer.
      • National technical regulation number.
      • Test results from an accredited laboratory confirming compliance with the national technical regulation for Group 2 products.
      • A conclusion that the product/good complies with the national technical regulation.
      • A commitment to product quality conformity with the national technical regulation and applicable standards, and taking legal responsibility for product quality and self-assessment results.
  • Dossier based on results from a registered or designated certification body (Third-Party):

    • A Declaration of Conformity (using Form 2. CBHC/HQ in Appendix III of Circular 28/2012/TT-BKHCN).
    • A certified copy of the Certificate of Conformity with the corresponding technical regulation, along with a sample of the conformity mark issued by the registered or designated certification body.

Registration Sequence

Pursuant to Clause 3, Article 1 of Circular 02/2017/TT-BKHCN, the sequence for declaration of conformity is as follows:

  • Declaration based on self-assessment results: For domestically produced products, the organization/individual submits the dossier to the specialized agency. After submission, the organization/individual is permitted to circulate the goods. They bear full responsibility for the self-assessment results and must ensure the goods comply with the technical regulation.

  • Declaration based on results from a registered or recognized certification body: For domestically produced products, the organization/individual submits the dossier to the specialized agency. After receiving a Notice of Receipt of the dossier from the specialized agency, the organization/individual is permitted to circulate the goods. They are responsible for ensuring compliance and must report any non-conformity.

  • Declaration based on results from a designated certification body: For domestically produced products, the organization/individual submits the dossier along with a certified copy of the Certificate of Conformity from the designated certification body. After receiving the Notice of Receipt, the organization/individual is permitted to circulate the goods.
