  2. The legal representative meets the following conditions:
  • Vietnamese citizens;
  • University degree or higher and at least 5 years of experience in the field of sending Vietnamese workers to work abroad under contracts of employment services;
  • Not subject to criminal prosecution;
  • Have no criminal record for any of the crimes of infringing on national security, crimes of infringing on human life, health, dignity, honor, crimes of fraudulent appropriation of property, crimes of abuse of trust and appropriation property, crime of false advertising, crime of deceiving customers, crime of organizing and brokering for others to leave, enter or stay in Vietnam illegally, crime of organizing and brokering for others to escape abroad or staying abroad illegally, the crime of forcing others to flee abroad or staying abroad illegally;
  1. Deposit according to Article 24 of the Law on Vietnamese Guest Workers 2020: Enterprises must deposit money at commercial banks to ensure the fulfillment of obligations to employees. The deposit level can be adjusted according to each specific labor market.
  2. Have a sufficient number of professional staff to carry out the prescribed contents.
  3. Have facilities of the enterprise or be rented stably by the enterprise to meet the educational requirements for orientation for Vietnamese workers working abroad under contracts.

Procedures for applying for a labor export permit

Documents need to be prepared

According to Clause 1, Article 12 of the Law on Vietnamese Guest Workers 2020, the permit application file includes:

  • Enterprise’s written request for a license, clearly stating the scope of operations.
  • A copy of the business registration certificate, ensuring proper registration of the service industry sending workers to work abroad.
  • Documents proving compliance with the conditions specified in Article 10.

Procedures for applying for a license

Step 1: Submit application

Enterprises submit an application for a license to operate labor export services to the Ministry of Labor, War Invalids and Social Affairs.

Step 2: Appraisal of documents and issuance of license

  • Within 20 days from the date of receipt of complete and valid documents, the Minister of Labor, War Invalids and Social Affairs shall review and issue a License to the enterprise;
  • In case the License is not granted, a written response must be provided clearly stating the reason.

  • Post a copy of the license at the head office within 30 days.
  • Post the license on the enterprise’s website.
